You should check with your State for any other licensing requirements to make sure the market center is meeting the State requirements but the following is the KWRI policy on Referral Agents and Referral (or Holding) Companies:
Referral Agents - Referral Agents are agents that the Market Center holds their license and receive referral income only. They do not engage in Real Estate activities regarding buying and selling properties. They only refer buyers and sellers.
Referral Company - A separate entity set up by the market center owners for the purpose of holding real estate licenses for agents that wish to keep their license active, while only referring real estate business. Per KW Policies and Guidelines the referral company must be owned by the market center. This falls under the affiliated businesses policies.
How your state handles Referral Agents will determine how the Associate is handled within the WinMORE system.
Referral Agent Licenses held by the Market Center:
Since the license is held by the market center, all rules apply to these associates the same as any other licensed associate. You will enter them into WinMORE and code with a status of A and production status R so they will pay the Associate Tech fee, and will be counted in agent count for the Market Center.
Referral Agent Licenses held by Referral Company:
1. New Associate joining Referral Company
If an agent joins the referral company, they are not entered into WinMORE until they have a downline. At the time that another associate joins and names the referral agent as a sponsor you will then enter the referral agent into WinMORE and they will be coded with a status of PO and production status O so they would not pay the Associate Tech Fee and would not be counted in agent count for the Market Center.
2. Transferring from Market Center to the Referral Company:
If an agent at any time transfers their license from your market center to the referral company and has no downline, they are to be removed following the same policies as any other associate transferring to another brokerage. If the agent does have a downline, KWRI allows them to remain in WinMore for profit share purposes however they would be coded with a status of PO and production status O so they would not pay the Associate Tech fee and would not be counted in agent count for the Market Center.
3. Transferring from Referral Company to the Market Center:
If an agent at any time transfers their license from the referral company to the market center, they will be added to WinMORE like any other joining associate following the same rules for sponsorship. If they have never been a part of KW you will add them as a new associate. If they have previously been with KW you will add them similar to a transferring associate with the same rules for vesting and sponsorship applying.
